1. ACCEPTANCE OF TERMS AND AGREEMENT

Welcome to ByteWise ("we," "us," "our," or the "Platform"), a comprehensive educational platform dedicated to providing programming education, artificial intelligence-powered code generation tools, and learning resources. By accessing, browsing, using, or registering an account on ByteWise (located at bytewise.com and any related subdomains, mobile applications, or services), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms," "Terms of Service," or "Agreement"), as well as our Privacy Policy and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not access or use our services.

These Terms constitute a legally binding agreement between you ("User," "you," "your," or "Learner") and ByteWise. Your use of the Platform indicates your acceptance of these Terms in their entirety. ByteWise reserves the right to modify, update, or change these Terms at any time without prior notice, and it is your responsibility to review these Terms periodically. 2. DESCRIPTION OF BYTEWISE SERVICES

ByteWise is an educational technology platform designed to provide comprehensive programming education through various interactive and innovative means. Our services include, but are not limited to:

  • Educational Courses: Access to over 38 programming courses covering various languages, frameworks, and technologies, including but not limited to Python, JavaScript, React, Node.js, TypeScript, HTML/CSS, SQL, Data Science, Machine Learning, and more. These courses include video lessons, interactive coding exercises, quizzes, projects, and assessments designed to facilitate learning at different skill levels.
  • AI-Powered Code Builder: An advanced artificial intelligence tool that assists users in generating code snippets, complete applications, and project templates based on natural language prompts and specifications. The AI Builder leverages state-of-the-art language models to provide intelligent code suggestions, completions, and generation capabilities.
  • Interactive Learning Environment: A browser-based integrated development environment (IDE) that allows learners to write, test, and execute code directly within the platform without requiring local installation of development tools.
  • Progress Tracking and Analytics: Comprehensive tools to monitor learning progress, track course completion, analyze quiz performance, and generate personalized learning paths based on user performance and preferences.
  • Community Features: Forums, discussion boards, code sharing platforms, and collaborative learning spaces where users can interact with fellow learners, share projects, seek help, and contribute to the learning community.
  • Quiz and Assessment Tools: Interactive quizzes, tests, and assessments designed to evaluate understanding, reinforce learning concepts, and provide immediate feedback on performance.
  • Certificates and Achievements: Digital certificates of completion and achievement badges that recognize and validate learning milestones and course completions.
  • Mobile Applications: Access to ByteWise services through mobile applications available on iOS and Android platforms, providing on-the-go learning capabilities.

ByteWise reserves the right to modify, suspend, or discontinue any aspect of the services at any time without prior notice. We may also impose limits on certain features or restrict access to parts or all of the services without notice or liability.

3. ACCOUNT REGISTRATION AND SECURITY

To access certain features of ByteWise, including saving progress, accessing AI Builder, and participating in community features, you are required to create an account. Account registration is free and requires you to provide accurate, complete, and current information. You agree to:

  • Provide Accurate Information: Furnish true, accurate, current, and complete information about yourself as prompted by the registration form, including but not limited to your name, email address, and any other required information.
  • Maintain Account Security: Maintain the security of your account and password, and restrict access to your account and computer. You are responsible for all activities that occur under your account, whether or not you have authorized such activities.
  • Protect Credentials: Not share your password or account details with any third party. You agree to notify us immediately if you suspect any unauthorized use of your account or any other breach of security.
  • Single Account Policy: Create only one account per individual. Multiple accounts created by the same person may be terminated without notice.
  • Account Ownership: Accounts are non-transferable and cannot be shared with others. Each account is intended for use by a single individual.
  • Age Verification: If we determine that you have created an account in violation of the age requirements, we reserve the right to terminate your account immediately.
  • Authentication Methods: ByteWise offers authentication through third-party providers such as Google and GitHub. By using these services, you agree to their respective terms of service and privacy policies in addition to our Terms.

Account Termination: ByteWise reserves the right to suspend or terminate your account at any time, without prior notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, abuse of the platform, or inactivity. Upon termination, your right to use the services will immediately cease, and we may delete your account and all associated data.

4. USER RESPONSIBILITIES AND CONDUCT

As a user of ByteWise, you agree to conduct yourself in a manner that promotes a positive, respectful, and educational environment. You are solely responsible for your use of the Platform and agree to:

  • Use for Educational Purposes: Utilize ByteWise primarily for learning, skill development, and educational purposes. Commercial use of free features is permitted for learning and portfolio development.
  • Respect Intellectual Property: Respect the intellectual property rights of others, including ByteWise, instructors, and fellow users. Do not copy, distribute, or misuse content that you do not have rights to use.
  • Community Standards: Engage respectfully with other users in forums, discussions, and collaborative spaces. Harassment, bullying, hate speech, discriminatory language, or any form of abusive behavior will not be tolerated.
  • Academic Integrity: Use AI-generated code and learning materials as learning aids and references. Presenting AI-generated work as your own original work in academic settings without proper attribution may violate academic integrity policies of your institution.
  • Professional Conduct: Maintain professional and courteous communication with ByteWise staff, instructors, and other users at all times.
  • Feedback and Reporting: Provide constructive feedback and report any bugs, issues, or violations of these Terms to help us improve the platform.
  • Compliance with Laws: Comply with all applicable local, state, national, and international laws and regulations while using ByteWise services.
  • No Reverse Engineering: Not attempt to reverse engineer, decompile, disassemble, or derive source code from any aspect of the Platform, except as expressly permitted by law.
  • No Interference: Not interfere with or disrupt the services or servers or networks connected to the services, or violate any regulations, policies, or procedures of such networks.
  • Accuracy of Information: Ensure that any information you provide to ByteWise is accurate, current, and complete. You agree to update such information to keep it accurate, current, and complete.

5. INTELLECTUAL PROPERTY RIGHTS

ByteWise and its licensors, suppliers, and partners own all right, title, and interest in and to the Platform, including all intellectual property rights therein. This includes, but is not limited to:

  • Course content, videos, text, graphics, images, animations, and instructional materials
  • Software, code, algorithms, and AI models powering the Platform
  • Trademarks, logos, service marks, and trade names (including "ByteWise")
  • Website design, layout, user interface, and user experience elements
  • Documentation, guides, and educational resources
  • Databases, collections, and compilations of information

Your Rights: Subject to your compliance with these Terms, ByteWise grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform for your personal, non-commercial educational purposes. This license does not include any right to resell or commercialize any ByteWise content or services.

User-Generated Content: You retain ownership of any content you create, upload, or share on the Platform, including code, projects, forum posts, and comments. However, by submitting content to ByteWise, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, adapt, and distribute your content for the purpose of providing and improving our services. This license continues even after you terminate your account.

Feedback: Any feedback, suggestions, or ideas you provide to ByteWise about the Platform or services becomes our property, and you assign all rights in such feedback to us. We may use your feedback without restriction and without compensation to you.

Copyright Infringement: ByteWise respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. If you believe your copyrighted work has been copied in a way that constitutes copyright infringement, please notify us immediately with detailed information.

6. AI BUILDER AND CODE GENERATION SERVICES

ByteWise AI Builder is an advanced artificial intelligence service designed to assist users in generating code, solving programming problems, and creating applications. The use of AI Builder is subject to specific terms and conditions:

6.1 Ownership of AI-Generated Code

You retain full intellectual property rights to code and content generated by AI Builder based on your unique prompts and specifications. ByteWise does not claim ownership of the output code. However, you acknowledge that AI-generated code may contain similarities to code generated for other users or may be based on publicly available code repositories.

6.2 Code Quality and Reliability

AI-generated code is provided "as is" without warranties of any kind. ByteWise does not guarantee that AI-generated code will be error-free, secure, optimal, or suitable for production environments. You are solely responsible for:

  • Reviewing and testing all AI-generated code before deployment
  • Ensuring code security and absence of vulnerabilities
  • Verifying compliance with relevant licensing and legal requirements
  • Understanding and maintaining the generated code
  • Obtaining necessary permissions for any third-party code or libraries used

6.3 Usage Limits and Fair Use

To ensure fair access to AI Builder for all users, we impose usage limits and rate restrictions. These limits may vary based on your account type and current system capacity. You agree not to:

  • Use automated scripts, bots, or other means to circumvent usage limits
  • Share AI Builder access with unauthorized users
  • Exploit the service for commercial code generation at scale without authorization
  • Generate malicious, harmful, or illegal code
  • Use AI Builder to compete with ByteWise or similar services

6.4 AI Training Data

While AI Builder processes your prompts to generate responses, ByteWise does not use your personal private code to train or improve our AI models. However, anonymized and aggregated usage data may be used to enhance the quality and performance of our services.

6.5 Content Filtering

AI Builder includes content filtering mechanisms to prevent generation of inappropriate, harmful, or illegal content. These filters may occasionally block legitimate requests. We continuously work to improve our filtering systems while maintaining useful functionality.

7. COURSE CONTENT AND EDUCATIONAL MATERIALS

ByteWise provides extensive educational content through courses, tutorials, and learning materials. Your access to and use of this content is governed by the following terms:

7.1 Access to Courses

ByteWise is committed to providing free access to our core educational content. All users can access our 38+ courses without subscription fees or credit card requirements. We may offer premium features, additional resources, or specialized courses in the future, which may require separate payment or subscription.

7.2 Course Completion and Certificates

Upon successful completion of courses, you may receive digital certificates acknowledging your achievement. These certificates are for personal and professional development purposes and do not constitute formal academic accreditation or professional licensure unless specifically stated otherwise.

7.3 Content Updates and Accuracy

We strive to keep our course content accurate, current, and relevant to industry standards. However, technology evolves rapidly, and we cannot guarantee that all content reflects the absolute latest developments. We regularly update and improve our courses, and you may notice changes in content over time.

7.4 Learning Pacing

You can learn at your own pace. There are no time limits for completing courses, and you can revisit completed courses as often as you like. Your progress is saved and can be resumed from any device.

8. PROHIBITED ACTIVITIES AND USAGE RESTRICTIONS

To maintain a safe and effective learning environment, the following activities are strictly prohibited on ByteWise:

  • Unauthorized Access: Attempting to gain unauthorized access to the Platform, other users' accounts, or any part of the system through hacking, cracking, password mining, or any other means.
  • Content Scraping: Using automated tools, scripts, or bots to scrape, harvest, or collect course content, user data, or any other information from the Platform without express written permission.
  • Malicious Code: Using ByteWise to develop, host, or distribute malicious software, viruses, malware, ransomware, or any code designed to harm systems or users.
  • Illegal Activities: Using the Platform for any illegal purpose, including but not limited to fraud, money laundering, terrorism, or violation of export control laws.
  • Spam and Abuse: Sending unsolicited messages, spam, or engaging in abusive behavior toward other users or ByteWise staff.
  • Copyright Infringement: Uploading, sharing, or distributing copyrighted material without proper authorization or licensing.
  • Impersonation: Impersonating another person, entity, or ByteWise employee, or misrepresenting your affiliation with any person or entity.
  • Interference: Interfering with other users' enjoyment of the Platform or disrupting the normal flow of discussions and activities.
  • Commercial Exploitation: Reselling ByteWise courses or content, or using the Platform to compete directly with ByteWise without authorization.
  • System Abuse: Overloading, flooding, spamming, or crashing the Platform's servers or systems.
  • Data Mining: Using data mining, robots, spiders, or similar data gathering and extraction tools on the Platform.
  • Security Violations: Introducing viruses, trojan horses, worms, time bombs, cancelbots, or any other computer code, files, or programs that interrupt, destroy, or limit the functionality of the Platform.

Violation of any of these prohibitions may result in immediate termination of your account and potential legal action. ByteWise reserves the right to investigate and take appropriate legal action against anyone who violates these terms or engages in fraudulent or illegal activities.

9. PRIVACY AND DATA PROTECTION

Your privacy is important to us. ByteWise collects, uses, and protects your personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

The Platform may contain links to third-party websites, resources, or tools that are not owned or controlled by ByteWise. 11. PAYMENT AND SUBSCRIPTION TERMS

While ByteWise's core educational content is free, we may offer premium features, additional resources, or specialized courses that require payment. Any payment or subscription terms will be clearly disclosed before you are charged.

11.1 Payment Methods

We accept various payment methods, including credit cards, debit cards, and other payment processors. You agree to provide accurate, complete, and current payment information. By providing payment information, you authorize ByteWise to charge the applicable fees to your chosen payment method.

11.2 Recurring Subscriptions

For subscription-based services, you will be automatically charged at the beginning of each billing cycle (monthly, annually, or as specified) until you cancel your subscription. You can cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle.

11.3 Refund Policy

12. SERVICE AVAILABILITY AND MODIFICATIONS

  • Maintenance: We may perform scheduled maintenance that temporarily interrupts service. We will attempt to provide advance notice when possible, but emergency maintenance may occur without notice.
  • Modifications: We reserve the right to modify, suspend, or discontinue any feature, service, or aspect of the Platform at any time without prior notice or liability.
  • Temporary Outages: Temporary outages, slowdowns, or technical difficulties may occur due to factors beyond our control, including internet infrastructure issues, third-party service disruptions, or unforeseen technical problems.

13. DISCLAIMER OF WARRANTIES

BYTEWISE PROVIDES THE PLATFORM AND SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BYTEWISE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Merchantability and fitness for a particular purpose
  • Non-infringement of third-party rights
  • Accuracy, reliability, or completeness of course content
  • Security and error-free operation of the Platform
  • Availability or uninterrupted access to services
  • Compatibility with your specific hardware or software
  • Results or outcomes from using educational materials
  • Correction of any defects or errors
  • Freedom from viruses or other harmful code

No advice, results, or information obtained by you from ByteWise or through the services will create any warranty not expressly stated in these Terms. Educational materials and AI-generated code should be used as learning aids and references. We recommend cross-referencing all information with official documentation and trusted sources.

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BYTEWISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, information, or profits
  • Loss of business opportunities or revenue
  • Damage to computer systems or software
  • Time, effort, or expenses incurred in using the Platform
  • Emotional distress or reputational damage
  • Any other damages arising from use or inability to use the services

IN NO EVENT SHALL BYTEWISE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID, IF ANY, TO ACCESS THE SERVICES DURING THE PRECEDING TWELVE (12) MONTHS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

ByteWise is not liable for the conduct, content, or actions of third parties, including other users, advertisers, or service providers. We are not responsible for any harm resulting from interactions with third parties through the Platform.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless ByteWise, its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use of and access to the Platform
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including copyright, trademark, trade secret, or other intellectual property right
  • Your violation of any law, rule, or regulation
  • Content you submit or post on the Platform
  • Your interactions with other users
  • Any misrepresentation made by you

ByteWise reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with ByteWise in asserting any available defenses.

16. TERMINATION OF SERVICE

ByteWise reserves the right to terminate or suspend your account and access to the Platform at any time, without prior notice, for any reason, including but not limited to:

  • Breach of these Terms of Service
  • Violation of applicable laws or regulations
  • Fraudulent or abusive activity
  • Inactivity for an extended period
  • Technical or security reasons
  • Business decisions to discontinue certain services

Upon termination, your right to use the Platform will immediately cease. ByteWise may delete your account and all associated data, including progress, projects, and user-generated content. We are not obligated to retain any data after termination.

You may terminate your account at any time by contacting our support team or using the account deletion feature in your account settings. Upon termination, you will lose access to all services and content, and any paid subscriptions will be canceled.

17. DISPUTE RESOLUTION AND ARBITRATION

Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be resolved as follows:

17.1 Informal Negotiation

Before resorting to formal dispute resolution, you agree to attempt to resolve any dispute with ByteWise through good faith negotiation. Please contact us at Codelearnz.help@hotmail.com to discuss any issues.

17.2 Binding Arbitration

If informal negotiation fails, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in the English language, and the arbitrator's decision shall be final and binding.

17.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in a class action, class-wide arbitration, consolidated action, or representative action.

18. GOVERNING LAW AND JURISDICTION

  • No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
  • Force Majeure: ByteWise is not liable for any failure or delay in performance due to causes beyond our reasonable control.
  • Electronic Communications: You agree to receive communications from ByteWise electronically, including email, notifications, and postings on the Platform.
